DPIAs under DPDPA: Moving Beyond Mandate to Meaningful Risk Awareness

As India’s Digital Personal Data Protection Act (DPDPA) begins to move from paper to practice, one thing is becoming increasingly clear—compliance, by itself, is not going to be enough.

Data Protection Impact Assessments (DPIAs), especially for Significant Data Fiduciaries (SDFs), are a good example of this. While the law positions DPIAs as a requirement, their real value lies elsewhere. They force organizations to confront an uncomfortable but necessary question early in the lifecycle of any data initiative: do we fully understand the risks we are creating?

There is also a tendency to view DPIAs as something that only applies to SDFs. That interpretation, while technically accurate, misses the larger point. Risk does not neatly follow regulatory classification. In many cases, smaller or mid-sized Data Fiduciaries (DFs) may introduce equally complex or impactful data processing activities—just without the same level of internal scrutiny.

For SDFs, DPIAs are expected to act as a baseline discipline. The DPDPA requires them as part of their broader obligations around managing risks to the rights of Data Principals. But in practice, they become far more than that.

Take a large fintech platform building out alternative credit scoring models. On the surface, this is innovation—expanding access, improving decision-making. But a DPIA introduces a different lens:

  • Are we introducing bias into financial decision-making without realizing it?
  • What happens when profiling logic is wrong—but still confidently applied?
  • Do users meaningfully understand how their data is influencing outcomes?
  • At what point does “data-driven” become “opaque and unchallengeable”?

These are not purely technical questions. They sit at the intersection of fairness, transparency, and accountability.

A similar pattern emerges in healthcare platforms managing electronic health records across systems. The risks here are not limited to data breaches or unauthorized access.

  • How consistently is consent being interpreted across systems?
  • Are third-party integrations expanding the data surface in ways we don’t fully track?
  • Is sensitive health data being repurposed in ways that users would not reasonably expect?

In both cases, the DPIA becomes less about documenting risk and more about slowing down decision-making just enough to ask better questions.

What is interesting, though, is how relevant this discipline becomes for Data Fiduciaries that are not classified as SDFs.

Consider a growing e-commerce platform rolling out an AI-driven recommendation engine. It feels like a standard feature—almost expected. But a DPIA often reveals a different picture:

  • Continuous tracking across devices without clear user awareness
  • Behavioral profiling that may go beyond what is necessary for personalization
  • Subtle algorithmic nudging that shapes user choices over time
  • Consent mechanisms that exist, but may not always be meaningful in practice

None of these issues are dramatic in isolation. But collectively, they define the kind of privacy experience an organization is creating.

Or take a startup implementing an internal HR analytics tool to measure productivity and engagement. Again, the intent is understandable—efficiency, insights, better decision-making. But intent does not eliminate impact.

  • At what point does monitoring become intrusive?
  • Are employees aware of the extent of analysis being performed?
  • Could these insights be used in ways that were never originally intended?
  • Is there a line between analytics and surveillance—and have we crossed it?

These are the kinds of questions that rarely surface unless there is a structured mechanism to ask them. DPIAs provide exactly that.

And this is where their real value lies.

They are not just compliance artefacts. They are a way to:

  • Move from fragmented data visibility to a more complete understanding of data flows
  • Challenge assumptions that often get embedded quietly into system design
  • Bring legal, technology, and business teams into the same conversation
  • Shift the narrative from “can we build this?” to “should we build this this way?”

This approach is not unique to India. Under the GDPR, DPIAs have long been associated with high-risk processing, particularly in areas involving profiling or sensitive data. Singapore’s PDPA, while taking a slightly different route, still emphasizes accountability and encourages organizations to assess and mitigate risks in their data practices.

The underlying philosophy is consistent across these frameworks:

  • Anticipate harm early
  • Design with accountability in mind
  • Treat risk assessment as an ongoing process, not a one-time exercise

For organizations operating across jurisdictions, this creates an opportunity to build a more unified and consistent approach to privacy risk management—rather than reacting differently to each regulation.

Looking ahead, there is still some uncertainty around how DPIAs will evolve within the DPDPA ecosystem, particularly once the Data Protection Board of India becomes operational. It is reasonable to expect that DPIAs may, over time, become relevant in the context of regulatory oversight, particularly in investigations, breach assessments, or accountability reviews.

At the same time, it is equally possible that the Board adopts a principle-based approach, allowing organizations flexibility in how they approach DPIAs. At this stage, drawing firm conclusions would be premature.

What does seem clear, however, is this: organizations that treat DPIAs as a checkbox exercise will likely miss their value entirely. Because at its core, a DPIA is not about producing a document. It is about creating a moment of pause.

A moment where organizations step back and ask—sometimes for the first time—whether their data practices align not just with regulation, but with expectation, fairness, and trust.

For Significant Data Fiduciaries, this moment is mandated. For others, it is optional—but increasingly necessary. And in a space where regulation is still evolving, that distinction may not matter as much as it seems.
